At DAAN, we assist with legal proceedings as well as mediation processes. Mediation is a way of bringing parties in conflict back into dialogue with each other. In other words, mediation is an effective way of discussing problems and resolving conflicts. This could involve, for example, a conflict between an employer and an employee or a dispute between shareholders.
Reasons for choosing mediation
In mediation, parties work together under the guidance of an independent mediator to find a solution. The aim is to arrive at a joint and supported solution based on the actual interests of the parties. The mediator has no vested interest in the outcome and ensures a fair and structured process.
There are several reasons to choose mediation:
– Quick solution: you can often reach a solution more quickly than through legal proceedings.
– Maintaining relationships: during mediation, you openly discuss the problems and differences of opinion, which can contribute to restoring or maintaining the relationship.
– Staying in control: you decide together what agreements are made, instead of a judge deciding who wins or loses.
– Flexible solutions: the agreements can be tailor-made, tailored to the situation and needs of both parties.
When to use mediation?
A (MfN-registered) mediator helps parties to (re)start the conversation. Together, they examine how the conflict arose, what interests are at stake and what the future might look like. The autonomy of both parties is paramount. No one is forced into anything; the solution comes from the participants themselves.
By using mediation at an early stage, escalation and legal proceedings can often be avoided.
Why choose a mediator who is also a solicitor?
Our society as a whole is permeated by rights, and parties in a conflict are increasingly invoking their rights. This is one of the reasons why it is beneficial for a mediator to be aware of the relevant legal issues that may arise in a particular conflict.

She often assists parties with problems in cooperation, communication issues and discussions about (sexual) transgressive behaviour. Hester is also often called in on the advice of company doctors.

Barbara specialises in corporate and insolvency law and enjoys supporting entrepreneurs with a wide range of legal issues. These may involve situations in which a company is under pressure, such as a WHOA process, but also other issues arising from day-to-day business operations. She assists entrepreneurs not only as a laywer, but also as a mediator, or as a laywer during a mediation process (mediation advocacy) in business conflicts.
